    • Mia Goth has been accused of battery by a background actor on her upcoming film “MaXXXine.”
    • James Hunter said he was diagnosed with a concussion after Goth kicked him in the head on set.
    • He also claimed wrongful termination after he was banned from the film set following the incident.

A background actor is suing Mia Goth, claiming she kicked him in the head on the set of the upcoming horror film “MaXXXine” and gave him a concussion.

James Hunter is also suing director Ti West and production company A24. He is seeking at least $500,000 in damages for battery and wrongful termination after the incident, which occurred in April 2023.

The lawsuit, which was shared by Deadline, says Hunter was hired for three days of work as a background actor to play the role of “Dead Parishioner” in “MaXXXine,” the third film in a trilogy of horror movies directed by Ti West and starring Goth.

The complaint claims that Goth, who plays the lead role in the film, was supposed to run past the actor, step over him, and look down as he was lying on the ground.

But on the fourth take, the complaint says Goth “nearly stepped” on Hunter, who reported this to the second assistant director.

The assistant director then warned the star “to be careful,” per the suit. But in the next take, Hunter claims Goth “intentionally kicked” him in the head “with her boot,” causing him “stiffness in his neck” and headache.

Hunter again reported the incident to the second assistant director, who notified Goth and West.

Per the suit, Hunter received no medical assistance and West said filming should continue.

After the scene was completed, Hunter claimed that Goth sought him out in a private bathroom where she “mocked” him.

“After intentionally kicking Plaintiff in the head, Defendant Goth invaded Plaintiff’s privacy in a bathroom; laughed at Plaintiff; taunted, mocked, and belittled Plaintiff; and dared Plaintiff to do anything about it,” the suit reads.

On the drive home from the overnight shoot, Hunter said that he pulled over and “nearly passed out twice” because of light-headedness, the suit continues.

The next day, Hunter then claims he was told he was being “taken off the production” for his next two days of filming and that he was banned from the set.

It says he was not given a reason for this.

Over the following two days, Hunter said he suffered from “head trauma symptoms,” including memory loss, confusion, and disorientation, leading to him making a trip to the hospital.

A physician who examined him concluded that he had experienced a concussion from having been kicked in the head, the suit says.

Representatives for all parties did not immediately respond to requests for comment from Business Insider, which were sent outside of regular business hours.

“MaXXXine,” which also stars Elizabeth Debicki and Michelle Monaghan, does not yet have a release date.
